Terms of Service

Article 1. Purpose

These Terms describe the relationship between VODAPLAY CO., LTD. (hereinafter the "Company"), which provides the Bodapark service, and the Members who use the Bodapark service in connection with the use of the Bodapark service, and explain the policy and technical measures taken by the Company in the course of providing the service. In addition, they include the copyright policy that Members must be aware of when using the digital content (hereinafter "Content") provided through the Bodapark service.

These Terms set out the basic matters such as the rights, obligations and responsibilities, the conditions and procedures of use, and content copyright necessary for a Member to use the Bodapark service, so please read them carefully.

Article 2. Effect and Amendment of the Terms

These Terms take effect for all Members who have agreed to them by being posted on the Bodapark service screen or notified by other means.

The Company may amend these Terms within the scope that does not violate the relevant laws and regulations where necessary. In the event these Terms are amended, the Company shall, as a matter of principle, give prior notice of the changes to Members at least 7 days before the effective date. However, in the case of an amendment of material content that may be unfavorable to Members, the Company shall give notice with a prior grace period of at least 30 days in advance and notify each Member individually through separate electronic means (email, in-service notification, etc.).

Where the Company has given notice of the changes in accordance with the preceding paragraph, if a Member does not express an intention to reject them by 7 days after the effective date of the amended Terms, the Member shall be deemed to have approved the amended Terms. A Member who does not agree to the amended Terms may terminate the service agreement (withdraw membership).

Matters not stipulated in these Terms shall be governed by the relevant laws and regulations or by legal custom.

Article 3. Definitions of Terms

The definitions of the terms used in these Terms are as follows.

  • Bodapark service: The AI-based platform for generating and editing video, images and other creative content provided by the Company, the function of connecting a Member's social media accounts to publish and manage the created content, and all related services in connection therewith.
  • Member: A person who has agreed to these Terms during the service agreement (membership registration) process in order to use the Bodapark service and has been granted a Bodapark account.
  • Content: Video, images, text and other digital outputs generated through the Bodapark service.
  • Channel: A digital social media platform such as Meta (Facebook·Instagram), YouTube, TikTok, Threads, or X on which Content is published through the Bodapark service.
  • Member channel: An account on a digital social media platform owned by a Member. A Member may connect their owned social media accounts to their Bodapark account through the channel connection function.
  • Bodapark Credit (C): A prepaid digital usage voucher exclusive to the Company that a Member may use in order to use paid features within the Bodapark service, such as AI content generation. Credits are automatically deducted upon use in accordance with the standards set by the Company, and cannot be refunded in cash or transferred to a third party. However, Credits paid for consideration may be refundable under certain conditions in accordance with the relevant laws and regulations and the Company's refund policy.
  • Extended service: Additional services provided to Bodapark Members.

Article 4. Formation of the Service Agreement

An application to use the Bodapark service is made by expressing the intention to agree to these Terms (selecting "I agree") together with entering certain information during the membership registration process.

The Bodapark service agreement is concluded when the Company accepts the registration after verifying the certain information entered by the user.

Article 5. Restrictions on Use

The Company strictly prohibits the following, and where such activity is detected, the Company may take appropriate measures, such as temporarily or permanently restricting the relevant Member's use of the service in whole or in part, or deleting the account.

  • Where the Company has previously deleted the relevant account pursuant to these Terms
  • Where required information is not entered or false information is entered when applying for membership registration
  • Where another person's email or social media account is misappropriated to register for membership or connect a channel
  • Illegal activity, or the generation of harmful or malicious content
  • Infringement of intellectual property rights
  • Attempting to reverse-engineer the platform or any act that interferes with the normal operation of the service
  • Where the service is used for discriminatory purposes based on race, gender, sexual orientation, religion, etc.
  • Other acts that violate the relevant laws and regulations

Article 6. Provision of the Service

Bodapark is an AI-based platform that enables users to generate video, images and other creative content using artificial intelligence tools and to publish them to the social media channels connected by the Member. This service may include integration with third-party AI providers, cloud services and social media platforms.

The Company makes its best efforts to provide the Bodapark service reliably 365 days a year, 24 hours a day. However, in the following cases the Company may temporarily or permanently restrict or suspend the service in whole or in part.

  • In the case of regular or temporary inspection for the maintenance and repair of service facilities, etc.
  • Power outage, failure of any facilities, or a surge in usage
  • Policy changes or suspension of third-party services such as social media platforms, natural disasters, or grounds of force majeure

When suspending or changing the service, the Company shall give notice a reasonable period in advance where foreseeable, and where unforeseeable shall explain and give notice without delay after the fact. In the event of a service suspension, the Company shall provide a reasonable and sufficient opportunity for users to back up their content.

Article 7. Accounts

Creating an account may be required to access certain features of the service. You agree to the following:

  • Provide accurate information and promptly correct it when it changes
  • Maintain the security of your account (including managing social login accounts and passwords)
  • Take responsibility for all activity carried out through your account
  • Not sell, transfer, lend or provide as collateral the right to use your account to any other person

We reserve the right to suspend or terminate accounts that violate these Terms. If you discover any unauthorized use, please notify the Company through the customer center.

Article 8. Protection of Personal Information

The Company collects and uses personal information only within the purpose and scope agreed to by the Member for the smooth provision of the service, and manages it securely in accordance with the laws and regulations relating to the protection of personal information.

The efforts the Company makes to handle personal information securely and other details can be found in the Bodapark Privacy Policy.

Article 9. Connection and Publishing to Social Media Channels

A Member may connect their own social media accounts (Meta (Facebook·Instagram), YouTube, TikTok, Threads, X, etc.) to their Bodapark account in order to publish content created on Bodapark to those channels or to schedule its publication.

Channel connection is carried out through the authentication (OAuth) procedure provided by each platform, and at the time of connection the Member agrees to the scope of access permissions required by the relevant platform and to the Company's data processing. A Member may disconnect a channel within the service at any time.

A Member must comply with each social media platform's terms of service, community guidelines and advertising policies with respect to all content published through a connected channel. The Company may terminate these Terms or restrict access to the Bodapark service if a Member violates the platform policies below.

  • Meta (Facebook·Instagram) terms of service and advertising policies
  • YouTube terms of service and advertising policies (when using YouTube, the YouTube Terms of Service and the Google Privacy Policy also apply)
  • TikTok terms of service and advertising policies
  • Terms of service of other connected platforms such as Threads and X

The Company may collect and display to Members the publishing results and performance data (whether published, views, likes, comments, etc.) through the official APIs of each platform, such as the YouTube Data API. A Member may revoke the Company's API access permissions at any time in the settings of each platform.

Advertising costs incurred on a Member channel are the responsibility of the Member and the relevant advertising platform operator, and the Company is not liable for publishing failures, feature restrictions resulting from a platform's policy changes, or any damage arising in the course of operating a channel.

Article 10. Payment for and Use of Paid Services

Most of the individual services that make up the Bodapark service can be used free of charge. However, free Members are subject to restrictions on the use of certain features, and even for paid Members there may be differences in the scope of service features and content utilization depending on the plan in use.

All payment information is securely processed by the relevant payment processor, and Bodapark does not store payment card information.

Recurring Payment (Auto-renewal)

The Bodapark paid service is a "recurring-payment product" for which the usage fee is automatically charged on a monthly or annual basis through the payment method designated in advance by the Member, and the usage period is automatically renewed. A Member may request to stop the recurring payment at any time in accordance with the prescribed procedure, in which case the Member may use the paid service until the end of the pre-paid usage period.

Where the recurring payment is not made due to a change in payment information, the expiration of a credit card, or any other reason, use of the paid service may be suspended without separate notice to the Member.

Succession of Recurring Payment Due to the Change of Service Name

For a Member who agreed to recurring payment (automatic payment) and registered a payment method under the former "Toktak" service, in accordance with the change of service name (Toktak → Bodapark) announced on June 8, 2026, the existing recurring payment consent and the registered payment method (billing key, etc.) are succeeded and maintained identically as the Bodapark recurring payment. The Company individually notified Members of the change of service name and the change in the payment statement description through email and in-service notification before the effective date, and a Member may cancel the recurring payment at any time in accordance with the notified procedure. If a Member continues to use the service after the effective date or does not express a separate intention to reject, the Member shall be deemed to have agreed to this succession.

Change of Plan

A Member may upgrade to a higher plan during use of the service, and the changed plan applies immediately from the time the upgrade is requested. Upon a plan upgrade, the difference is calculated on a pro-rata daily basis based on the number of days used under the previous plan and the application period of the new plan, and is additionally charged.

A Member may apply to change to a lower plan (downgrade) before the end of the billing cycle, and the changed plan applies from the next payment date. Detailed conditions relating to adding channels, changing plans or applying discounts are provided through a separate policy within the service.

Article 11. Referral Program and Coupons·Promotions

Referral Program

A Member may enter a referral code only once at the time of registration, and the referrer cannot be changed thereafter. The Company may provide rewards such as Credits to referrers and referees who meet certain conditions, and the standards and scope for granting rewards shall follow the Company's policy or the notice of an individual promotion. The Company may change, suspend or recover them without prior notice. Where duplicate registration is confirmed using the same IP, payment method, phone number, etc., the referral benefit shall be recovered and the relevant account may be restricted.

Coupons and Promotion Codes

The Company may issue coupons or promotion codes subject to certain conditions. A coupon is valid for 1 year from the date of issuance (or as otherwise specified where so stated), and a coupon not registered within the validity period automatically expires and cannot be restored, refunded or extended. A coupon cannot be refunded in cash or transferred to another person, and may be used only when using a paid service. The Company may recover a coupon or restrict its use without prior notice where it determines that there is a possibility of misuse or abuse of the coupon or a violation of the relevant laws and regulations. The Company may convert and grant a coupon as Credits, and the nature (paid/event), validity period and conditions of use of the converted Credits shall follow the separate policy in effect at the time of conversion.

Article 12. Credits

"Bodapark Credit" (hereinafter "Credit") is an exclusive usage voucher usable only in the Company's single service. Credits are deducted upon the use of a specific service in accordance with the policy set by the Company, and the deduction standards and the calculation of Credit value shall follow the Company's policy. Credits are deducted at the time when a generation request is received and the provision of digital content begins, and used Credits may be restored only where it is confirmed that no result was generated at all due to a system, network or external API error.

Deduction order: Credits are automatically used in the order in which the validity period arrives first (FEFO), and where the expiration date is the same, they are used in the order of event/promotional → paid (subscription → package).

Credits cannot be refunded in cash or transferred, assigned, lent or provided as collateral to a third party, and cannot be used in any manner not approved by the Company. They have no monetary value outside the platform.

These Credits are distinguished from those subject to registration as prepaid electronic payment means under the Electronic Financial Transactions Act, and may be reviewed again in accordance with the relevant laws and regulations in the event of a change in the business structure, such as an expansion of affiliated merchants or an expansion of the scale of issuance.

Article 13. AI-Generated Content

Content generated through Bodapark is generated by an artificial intelligence system. We do not guarantee the accuracy, uniqueness or freedom from errors of the generated content. Users are responsible for reviewing and verifying the generated content before using it or publishing it to a social media channel.

Article 14. Obligations of Members

A Bodapark account may be used only by the Member themselves, and use may not be permitted to any other person.

When there is a change to the information registered with the service, a Member must correct it directly or notify the Company of the change through the customer center. The Company is not liable for any problems arising from a failure to correct changes in a timely manner.

A Member must ensure that the content published to a connected social media channel does not violate the relevant laws and regulations such as the Juvenile Protection Act and the Copyright Act, and the policies of each platform, and the responsibility arising from a violation rests with the Member.

Where a free Member has no record of use of the Bodapark service for 1 year or more, that Member is classified as inactive, and the relevant data may be deleted. Deleted data cannot be recovered.

Article 15. Change and Termination of the Agreement

When a Member no longer wishes to use the Bodapark service, the Member may at any time apply to terminate the service agreement (withdraw membership) using the function provided within the service, and the Company shall process it without delay as prescribed by the laws and regulations. However, a Member who is using a paid service may apply to terminate the service agreement after the paid service usage period has ended.

When the service agreement is terminated, all of the Member's data, including account information, connected social media channel information and all content created by the Member, shall be deleted, except where the Member's information may be retained in accordance with the laws and regulations and the Privacy Policy, and deleted data cannot be recovered.

Article 16. Limitation of Liability

To the extent permitted by the laws and regulations, the Company makes no covenant or warranty regarding any specific matter not stated in these Terms in connection with the service.

We are not liable for the following:

  • Damage occurring in a state of natural disaster or force majeure equivalent thereto
  • Damage caused by the willful misconduct or negligence of the user
  • Damage caused by a third party unlawfully accessing the server or by malicious programs
  • Damage caused by data loss or service suspension
  • Damage caused by the acts of a third-party platform, such as a social media platform's policy changes, refusal to publish, or account suspension
  • Third-party copyright infringement resulting from the use of generated content

Where a Member suffers damage due to the Company's negligence, the Company shall compensate the Member for the damage in accordance with these Terms and the relevant laws and regulations. However, to the extent permitted by law, the Company is not liable for indirect damages, special damages, consequential damages or punitive damages.

Article 17. Resolution of Disputes

These Terms and the Bodapark service are governed and performed in accordance with the laws and regulations of the Republic of Korea. If a dispute arises between the Company and a user in connection with the use of the service, the parties shall consult in good faith to resolve it. If it is nonetheless not resolved, a suit may be filed with the competent court under the Civil Procedure Act. However, in the case of a consumer whose ordinary place of residence is in a country other than the Republic of Korea, consumer protection under the mandatory provisions of that country may apply with priority.
